What is USCIS Form I-9?

 

Form I-9 is a U.S. Citizenship and Immigration Services (USCIS) legal form that all U.S. employers use to validate the identity of individuals and determine their legal clearance for employment. It may be accomplished by both U.S. employers, employees, or authorized representatives of employers. Officially called the Employment Eligibility Verification, it is mandatory for employers to complete the form within three days of hire for each individual, as this would attest to employees’ rights for employment. Employees may also attest employment authorization by providing additional legal documents that confirm identity and employment rights.

 

Employers should keep Form I-9 for three years after an employee’s date of hire or for one year after the employment is terminated, whichever is later. The form does not have to be filed with local, state, or federal government; however, it should be available for inspection if requested by authorized U.S. government officials from the Department of Homeland Security (DHS), Department of Labor (DOL), or Department of Justice (DOJ).

 

How to Fill Out USCIS I-9

 

Form I-9 contains three sections that require an employer and an employee to fill out.

 

Section 1 — Employee Information and Attestation

 

This section should be completed by an employee no later than the first day of his or her employment, but not after accepting a job offer.

 

Full Legal Name asks for the full legal name of the employee.

 

Address asks for the current complete address of the employee.

 

Date of Birth asks for the date of birth of the employee in MM/DD/YYYY format.

 

U.S. Social Security Number asks for the unique SSN of the employee.

 

Employee’s Email Address asks for the email address where the employee should receive email notifications.

 

Employee’s Telephone Number asks for the contact number of the employee.

 

Section 1 contains four checkboxes that an employee should mark to specify citizenship or immigrant status. If the employee is a lawful permanent resident, provide Alien Registration Number or USCIS Number. If the resident is an alien authorized to work, provide the end date of work permit and Alien Registration Number or USCIS Number, Form I-94 Admission Number, or Foreign Passport Number and the Country of Issuance.

 

Signature of Employee requires the signature of the employee for validation.

 

Today’s Date asks for the date Section 1 was completed by the employee.

 

Section 1 also has a Preparer and/or Translator Certification part. Determine the use of a preparer or translator by marking the appropriate checkbox. If a preparer or translator was used, provide the name and address, let him or her sign the document, and write the date Section 1 was completed.

 

Section 2 — Employer or Authorized Representative Review and Verification

 

This section is for the employer or authorized representative to complete within three business days of an employee’s first day of employment.

 

Employee Info from Section 1 asks for the full legal name and citizenship or immigration status of the employee.

 

The employee must submit unexpired and original documents that confirm identity and employment authorization. The section contains List A, List B, and List C. The employee should present a single document for List A or a combination of two documents for List B and List C. Refer to the Lists of Acceptable Documents on the instructions page of Form I-9. Regardless of provided documents, write on the form the document title, issuing authority, document number, and expiration date.

 

The employer should specify the start date of the employee. To complete Section 2, the employer should provide a signature, title, full legal name, business or organization name, and address of business or organization.

 

Section 3 — Reverification and Rehires

 

This section is for the employer to complete when the employee needs to undergo re-verification due to expired employment documentation or authorization, or if re-hiring has occurred. If the employee’s previous grant of employment authorization has expired, provide the document title, document number, and expiration date. If re-hiring, provide the full legal name of the employee and date of rehire.

 

To validate Section 3, the employer needs to provide a signature, the date the section was completed, and his or her full legal name.
